User Agreement

This document will outline the Terms and Conditions for Users of Equiauctions.co.uk

1. Fees and Services

1.1 Services

The use of Equiauctions implies the Users acceptance of all Terms and Conditions.

Equiauctions is an interactive on-line Auction venue.  We are not Auctioneers rather we publish items submitted by "Users".  Equiauctions is not involved in the actual transaction between buyers and Sellers.

We obviously have no control of the safety, quality or legality of the items advertised.  We assume that the Users list the items in good faith and accuracy.

Equiauctions are not responsible therefore cannot ensure the Buyer and Seller will actually complete the transaction.  Equiauctions do not own the items listed- therefore we cannot transfer ownership from the Seller to the Buyer.

The User, after registration will be able to use the services of Equiauctions

Equiauctions shall have the discretion to register or deny access to Equiauctions Users at any time.

Equiauctions reserve the right to modify or discontinue any feature of Equiauctions including but not limited to content, systems and hours of availability at any time without the need for prior notice.

In no event is Equiauctions liable for any loss or damage including indirect or consequential loss or damage.

1.2 Fees

At Equiauctions we endeavour to give you absolute value for money, and believe in offering our customers a service that is not only  simple to use but fair and cost effective, therefore we have a nil listing fee, allowing you to list your goods for free. 

You will only be charged if your goods sell, so for example you sell a pair of jodphurs for £15.00 you will be charged our flat final value fee of 2.0% which would mean you would be charged only 30p!

There are also a number of options you may choose to maximize your listings.  Please note that these fees will re-occur when the adverts are automatically re-listed. Upgrade fees apply whether the items sells or not.  These fees are:

Fees are charged on the first of each month for the previous month’s activities.  At the beginning of the month you will receive an invoice outlining the fees in which you owe.  You will then have 7 (seven) days to make the payment via the site with either credit card or PayPal.  Another option is to deposit the money directly into our bank account. Please contact us for details.  If your account is not settled within 7 days your access to the site may be restricted.

Bidding is free on Equiauctions however you must register and accept the fees you may be charged before you are able to list an item on Equiauctions. 

We reserve the right to change the fees without any prior notice to the user

Unless otherwise stated all fees will be in GBP.  You are responsible for all fees associated with using the services of Equiauctions.

2. Bidding, Buying and Selling

The User agrees to comply with all the terms and conditions hereof.  The right to Use Equiauctions is agreeable by the User and not transferable.

Registration and Bidding is free on Equiauctions however you must register before you are able to Bid on or Sell items.

If contact is made with a potential buyer of your item through Equiauctions, the sale therefore belongs to Equiauctions.  If auctions are closed and sales made personally with other Equiauctions Members, your Membership will be terminated.

As a Seller you are obliged to sell the item to the winning Bidder for the price as stated at the end of the Auction.

As a Buyer, you are committed to buy the item from the Seller at the price stated at the end of the Auction. (if you are the winning Bidder) 

3. Listings

The "free until sold" policy is available to all members of Equiauctions.  If upgrades are chosen such as the options detailed in Fees 1.2 then the chosen fees will be applied to your account before the item is sold.  Upgrade fees are payable regardless of the outcome of the auction.

Because of the "free until sold" we request that no other websites or URLS, email addresses or phone numbers be contained within your listing.  *the only website addresses permitted within your listings are those leading to further information on the item you have listed.  No links to other external websites that sell the same or similar items or have shopping carts are permitted.  If listings are found to have such external links, they will be removed without notice to the member.

Listings need to have accurate prices.  A greatly reduced price or "free" on your item in an attempt to gather leads is not permitted.  These listings will be removed.

4. Confidentiality

The User is responsible for the confidentiality of his or her User names and Passwords.

The User is responsible for any activity in their account.  Any suspected fraudulent activity must be reported immediately to urgent@equiauctions.co.uk 

5. Privacy Policy

6. Intellectual Property

All intellectual Property including Trademarks, Logos and Domains are the exclusive rights to Equiauctions.co.uk.  The User does not acquire the right to reproduce, distribute or transform any of the intellectual Property.  All rights Reserved.

7.Permitted Uses

The User shall use the site for Lawful purposes only.  Users shall not post any items or material which infringes in any way the rights of others.  Users shall not use the site in ways which is invasive of Privacy laws.  Therefore the User agrees not to breach any rules of use of the internet or laws applicable to United Kingdom or the country the User resides.

The User does not have the right to use Equiauctions content without the prior written authorisation of Equiauctions.

The User does not have the right to limit or constrain any other User from Using Equiauctions.

Users shall not use Equiauctions to advertise any commercial solicitation including but not limited to, the solicitation of Users to become subscribers of other on-line informational services which may or may not be competitive with Equiauctions.

Users shall not upload or post any material protected by copyright or trademark without the permission of the owner of the copyright.

Any material submitted to Equiauctions by the User automatically grants Equiauctions the non exclusive rights to use and publish the image and information.  This may include but not be exclusive to advertising.

The User also permits other Users to access, view, store or reproduce the material for the Users personal use.

 8. Disclaimer

The User agrees that the Use of Equiauctions is entirely at the Users sole risk.

Neither Equiauctions, its affiliates nor any of their respective employees, agents, 3rd party providers warrant that Equiauctions will be uninterrupted or free of errors.  Although every precaution will be taken to avoid such action.

Equiauctions do not make claims to the success, reliability or content of any listing.

No guarantees are made to the outcome of each listing, nor are there any warranties on any product sold via Equiauctions.  Equiauctions do not own any of the products.  It is a separate transaction between the buyer and the Seller.  (Users)

9. Monitoring

Equiauctions have the right, but not the obligation to monitor the content on Equiauctions to determine suitability, satisfy laws and terms and conditions.

Equiauctions have the right to edit, refuse or remove any material posted.

10. Termination

Equiauctions may terminate this agreement at any time or a Users account in the event of misconduct, unacceptable behaviour or any breach or any agreement.

11. Refunds/Cancellation Policy

The buyer never paid me for the item they bought, now I have fees what can I do?

Please always make sure that you inform us of a non-paying buyer, as well as leaving appropriate feedback so others are aware.  Please email us your username, item number and the buyer you purchased from and we will refund your fees charged b us please contact us on urgent@equiauctions.co.uk to enable us to process this, please allow up to 30 days for a credit to your account.  

There are no warranties given by Equiauctions to any product which is sold via the website. The User is responsible for his or her User name and Passwords.  If fraudulent activity is suspected within your account, it must be reported immediately to urgent@equiauctions.co.uk 

In the case where the activity is proven to be fraudulent and unauthorised amounts have been charged to your account, a refund or credit will be issued totalling that amount.

In the unlikely case of the above, the method will be: 1) Credit to your account, or 2) refund which will be via the payment method you currently have on file.  Before such time, please verify that all your contact information is correct by clicking on "My Account"

Can I cancel my listing or end my listing early?

Yes you can, simply sign into your account and go to the "my account page". click on your active listings and then click on the individual listing you want to end it early. There you will see an option to end the auction early. You will not be charged as you 
there are no listing fees.
 
12.Competitions

Yes you can. Sign into your account and go to the “my account page”.  Click on your active listings and then the individual listing you want to end early.  There you will see an option to end the auction early. You will not be charged as there are no listing fees.

From time to time Equiauctions will run promotions, competitions and incentives.  The user agrees that should they win any such prize, they consent that their name to be published on the website and or in the Newsletter as the winner of any such prize.

13.Storefront

Business listings should consider a Storefront.  A business listing is defined by a member with one or more of the following:

·         Multiples of the same item.

·         Has an independent website in which they also sell their items

·         Produces personalised/ customised products.

·         Manufactures goods- or has goods manufactured.

·         Sells business opportunities. - please note unsuitable business opportunities    will be removed from the site.
